Terms of sale for consumers

1. Scope
These terms apply only when you buy Steel FugeMads on fugemads.com as a consumer, meaning a private individual acting mainly outside your trade or profession.
All other FugeMads products (Pure Tone, Stone Echo and Shadow Tone) are sold only to businesses through the partner portal under our separate business terms. Those business terms do not apply to this purchase and do not limit your consumer rights.
Business buyers should order through the partner portal.

3. The product
Steel FugeMads is a neutral-cure silicone sealant with a metallic steel look, in a 150 ml cartridge for a standard sealant gun.
Main characteristics, uses and limitations: see the product page and the technical data sheet. Formulated for brushed and satin stainless steel. Mirror-polished, black or coloured metal may look different.
It is a standard product, not made to your specifications.
Safety information and instructions are on the cartridge label. Read them before use.
4. Prices
Prices are in Danish kroner (DKK) including 25% VAT.
Price per cartridge: DKK 1,195.00.
Delivery is free. No other fees. No card surcharges.
The total price including VAT and delivery is shown before you complete your order.
5. Payment
You pay through our payment provider Stripe by card, Apple Pay or Google Pay, and by the other methods shown at payment.
We never see your card details. Stripe processes the payment; see our privacy policy.
The amount is reserved when you order and only charged when your order is shipped.
6. Ordering and conclusion of the contract
You order by choosing a quantity, entering delivery details, accepting these terms and pressing "Buy and pay".
The contract is concluded when you press the order button and the payment is authorised. You will receive an order confirmation by email with these terms and the model withdrawal form attached.
Please check the confirmation and contact us right away if anything is wrong.
We store the order and email it to you. These terms are always available at https://steel.fugemads.com/terms.
7. Delivery and risk
We deliver to addresses in Denmark (not the Faroe Islands or Greenland).
We ship within 2 working days. Expected delivery 2-4 working days after you order. We deliver no later than 30 days after the contract is concluded unless otherwise agreed.
Carrier: DAO. You get an email when the parcel ships.
Risk passes to you when you (or a person you designate, other than the carrier) take physical possession of the goods.
8. Right of withdrawal (14 days)
You have 14 days to withdraw from the contract without giving a reason. The period runs from the day you (or a person you designate, other than the carrier) take physical possession of the goods; for several cartridges delivered separately, from receipt of the last one.
How to withdraw: Use the "Cancel my order" button at https://steel.fugemads.com/withdraw. It is also at the bottom of every page and in your order confirmation. You will immediately receive an email receipt with the content of your withdrawal and the date and time it was submitted. You can also send a clear statement to hello@fugemads.com or by post to FugeMads ApS, Kirkevej 46, 4872 Idestrup, Denmark. You may use the model withdrawal form, but you do not have to. You meet the deadline if you send your notice before the 14 days have expired.
Returning the goods: Send the goods to FugeMads ApS, Kirkevej 46, 4872 Idestrup, Denmark, without undue delay and no later than 14 days after telling us that you are withdrawing.
Return costs: You will have to bear the direct cost of returning the goods. A cartridge can be sent as an ordinary parcel, approximately DKK 45.00.
Refund: We refund all payments received from you, including standard delivery, without undue delay and no later than 14 days from the day we receive your withdrawal notice. We use the same payment method you used unless you expressly agree otherwise; you pay no fees for the refund. We may withhold the refund until we have received the goods back or you have supplied proof of return, whichever is earlier.
Condition of the goods: You are only liable for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods. You can inspect the colour through the clear cartridge and read the label and data sheet at no cost. If you cut the nozzle, break the seal or dispense sealant, curing starts and the cartridge can no longer be resold. We may then deduct the diminished value from the refund, which may be up to the full price. You do not lose the right of withdrawal.
None of the statutory exceptions to the right of withdrawal applies to Steel FugeMads.
9. Faulty goods (statutory guarantee)
Under the Danish Sale of Goods Act you can claim for defects that become apparent within 2 years of delivery.
A defect that becomes apparent within 1 year of delivery is presumed to have existed at delivery, unless this is incompatible with the nature of the goods or the defect.
Notify us within a reasonable time after discovering the defect; notice within 2 months of discovery is always in time.
Remedies: repair, replacement, price reduction or termination under the Act. For a cartridge this will normally be a new cartridge or a refund.
It is not a defect if the problem results from use contrary to the label and data sheet, or use after the shelf life. Minor differences in appearance between steel types are not a defect as long as the product matches the product page description and images.
Contact hello@fugemads.com with your order number, a description and preferably a photo. We cover reasonable costs of returning faulty goods.
We give no commercial guarantee beyond the statutory rights.

If we cannot agree, you can complain to Nævnenes Hus (Mæglingsteamet for Forbrugerklager, then Forbrugerklagenævnet), Toldboden 2, 8800 Viborg, Denmark, via the complaints portal at naevneneshus.dk.
11. Personal data
We process your name, address, email, phone, order and payment status to perform the contract and comply with the Danish Bookkeeping Act. Stripe processes your payment; the carrier receives delivery details. See fugemads.com/policies.
12. Governing law and jurisdiction
Danish law applies. You can always bring proceedings in the courts where you live.
13. Changes
We may change these terms for future orders. Your order is governed by the version in force when you ordered, which you received by email.
Withdrawal information
Right of withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods.
To exercise the right of withdrawal, you must inform us, FugeMads ApS, Kirkevej 46, 4872 Idestrup, Denmark, phone +45 22 51 51 75, email hello@fugemads.com, of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or email). You may use the model withdrawal form below, but it is not obligatory.
You can also exercise your right of withdrawal online at https://steel.fugemads.com/withdraw. If you use this online function, we will send you without undue delay an acknowledgement of receipt of the withdrawal on a durable medium (e.g. by email), including its content and the date and time of submission.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
You shall send back the goods or hand them over to us at FugeMads ApS, Kirkevej 46, 4872 Idestrup, Denmark, without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
